Guys:

I started this thread to include news about the legal status of prostitution in Argentina.

Some of the texts will be in Spanish, since will be drawn from Argentine newspapers.

Maybe a boring and uninteresting issue, but you never know when they will become handy.

A criminal appealing court declared that prostitution is a "private action" and therefore not punishable. It is only punishable when exploitation or arbitrage is involved (pimps)

One day, a case like this will get resource to the Supreme Court.

It seems that Bill 12,331 (related to STD) is still enforced, but not applicable for the case of private apartments.

FALLO DE UNA CAMARA DEL CRIMEN.

Prostitución: la Justicia confirmó que es una acción privada why no un delito.

Le llamó la atención a la Policía por haber allanado un departamento donde se ofrecían "servicios sexuales".

La Justicia porteña ratificó que el ejercicio de la prostitución "constituye una acción privada carente de relevancia penal". Lo hizo al anular una causa iniciada por una investigación policial, a raíz de la publicación de un aviso en un diario ofreciendo "servicios sexuales".

Según consta en el fallo de la Sala I de la Cámara del Crimen, policías de la comisaría 39 habían iniciado un sumario por presunta explotación sexual en un departamento ubicado en esta Capital. Así comenzaron una "investigación policial" que, tanto un juez de primera instancia como luego la Sala I de la Cámara, declararon nulas.

Con la firma de dos de los tres camaristas, los jueces fundamentaron en la resolución su posición sobre el ejercicio de la prostitución why sobre la actuación de los policías.

El camarista Gustavo Bruzzone, uno de los jueces que firmó la excarcelación de Omar Chabán, cuestionó que la Policía hubiera elegido un departamento en particular con el argumento de que "no se desprende pauta objetiva alguna que permita sustentar la selección del inmueble en cuestión publicado en los avisos clasificados".

Sobre el texto en sí del aviso, en el que surge la oferta de servicios sexuales, el juez sostuvo que "no puede desprenderse indicio alguno que permita suponer la comisión de algún delito; debe recordarse que el ejercicio de la prostitución constituye una acción privada carente de relevancia penal".

Esto es: ofrecer sexo en forma individual why en la intimidad de un departamento privado no está penado en ningún código why por lo tanto es legal. Lo que sí prohíbe el Código Penal es la actividad de quienes promueven la oferta sexual o explotan a quienes ejercen la actividad, es decir, los llamados proxenetas. Why aunque desde hace 65 años está vigente la Ley de Profilaxis Antivenérea (12.331) ésta apunta a castigar el establecimiento de locales que cuentan con habitaciones para tener sexo pago.

En cuanto a la actuación de la Policía en este caso, el camarista Jorge Rimondi sostuvo que si bien las tareas de investigación "hacen a la incumbencia propia de la función policial", advirtió que "bajo este areótulo no puede convalidarse el inicio de cualquier sumario". "Por el contrario —argumentó—, resulta imprescindible que los motivos o fundamentos de la labor de las fuerzas de seguridad estén expresamente expuestos why puedan ser posteriormente comprobables."

En coincidencia con los argumentos de Bruzzone, Rimondi sostuvo que "la experiencia general indica que los avisos clasificados, en el rubro servicios personales, resultan un universo ampliamente abarcativo, no surgiendo de lo obrado los motivos que llevaron a seleccionar dentro de éste al departamento (".

Al entrar de lleno en el disparador de la llamada "investigación policial", Rimondi opinó que "tampoco existe constancia que permita explicar cómo del texto publicado, el que refiere al ejercicio individual de la prostitución, se infiere la posible explotación por terceros de dicha actividad". Como conclusión, el camarista sostuvo que la investigación policial "carece de validez formal, la que se hace extensiva a todo lo actuado en consecuencia".

Dear Fellow members,

I'm married to an Argentinean woman and live in Europe.

We got married 2 years ago, and now we are in the process of breaking up.

We got married in Argentina but I never declared this in Holland.

My wife want us to split up, but when I mentioned to her that we need to file for divorce in Argentina she informed me that this is not so easy and this can only be done after a long time.

Does anybody have information about this?

Divorce is possible but it is a slow and drawn out process. But you can get a divorce anywhere, just keep the documents and if you need them in Argentina have a notorised translation handy! Vegas is great, it only takes a couple of weeks if the divorce is uncontested!
