Hello,

I recently contacted ARCA in regards to obtianing and processing a visa for an extended stay in Argentina, (1-3yrs) with the possibility of becoming a permanent a resident. I disclosed to them I have a felony conviction on my record.

They responded they can not garantee I will get the visa I want. And suggested I go to the Argentina Embassy to discuss this with them before I apply, to get approval and consider the conviction first.

So my question is, do they routinely deny americans who have a felony on there record? Is it an automatic denial for a visa? Or do they or will they consider people on a case by case basis? If so, is there any way around this?

Any help is greatly appreciated.

Loch, all kidding aside, I do know one person who has a foreign conviction who got a residency permit. It was ancient history in that case, however.

It was ancient history in that case, however.Well its not a sex crime, robbery, rape, or anything heinous. But it's also something rare and unheard of, and when mentioned, people may freak out. In today's mindset, I'd rather not say as it publicly, as it would open me to possible flaming by others.

So any advice is welcome.

I've had criminal checks done various times. IIRC, the check done for the initial temp visa is for felonies in the last five years and you obtain the local police records from all US jurisdictions lived in for the last 5 years. I don't remember them verifying that the proper jurisdiction (s) was provided by the applicant.

At other stages, I had to get a report from the FBI which would catch crimes in any state / juris. Ive also had to get criminal reports from every provincia of Argentina.

These regs can change so its best to consult with an immigration specialist which is pretty cheap. For intance, a full medical exam was required when I initially entered as a resident, but I think it no longer is.

I'm somewhat like Teflon Don, so criminal records were not an issue. BTW Im on the edge of my seat - what was your rare, freaky, unheard of crime!;)

Actually the State of Texas mysteriously lost my driving records right about the time I quit drinking/cocaine/other and decided to pursue a political career just like Daddy. The multiple DWIs/other(?) could have been a problem.

The left leaning drivers registration employee had the last laugh though when she issued me a "new" drivers licence# of 99999999, which would seem rather suspicious when investigated years later. She just knew that wierd number would raise a red flag and come back to haunt me some day. I should have been smarter and gotten a different, normal number. But me and Jeb were able to "fix" everything anyway.

Screw the visa. I've been here for years without one. Just go to Uruguay every three months.

I would never suggest doing something like this, but you could give a *false* US state/city of residence in which you don't have a criminal record. Im 90% sure that migraciones never made me prove that I actually lived in the city listed. They dont know the difference between Las Vegas or Little Rock anyway. My having to get an FBI record was sort of a fluke that happened much later - many people only have to provide 5 years of criminal history from the local police of their jurisdiction (no FBI) which leaves some room for, umm, creativity. Damn I've been hanging out with attorneys too much.

In fact I'm still on probation, I get off my probation next month, and during all this time, I have flown to Mexico several times, Colombia, Scotland, and of course Buenos Aires more recently. And since I will be free to live anywhere next month, I am looking at argentina.

Ah fuck it, I got busted with a small amount explosives, blasting caps C-4, and TNT. This was in mid 2001, before the 9-11 shit, so I am thankful in a way it was before then, had it happen after 9-11 I'm sure I would be sharing a cell with someone down in Guantanamo Bay. Don't ask me why I had it, to me, it was nothing more than exotic boy boy toys.

I was set up by the local cops in my town, because I ran a website that was too critical of our local city government policies, and police department, and they harrased many of its citizens who did not warrant such behavoir, not to mention they trumped up charges, falsified statements and evidence, guess they don't know how to take a fucking joke.

I normally have a lot of respect for cops, but if you had seen what I had seen, you'd be in an uproar as well.

So went to court, went to preliminary hearings, judge threw my case out, (the sound of everyone gasping when the judge did that was priceless) 3 months later they refiled charges and came at me a different way and it stuck, only did 6 days in county, and 5 years probation. And its still in limbo, not sure how to put it, but at the end of my 5 years probation, we can petition the court to get it dropped down to a misdemeanor. So maybe then it won't show up on my record?

You could list Boise as your residence for last 5 years and obtain your clean police record from that city/department. Would anyone be victimized by doing that?

My grandfather lied about his country of origin to get on the immigrant boat from the Old Country to Ellis Island many years ago. It turned out pretty well for all of us.

Things are quite different now, with all this terrorist bullshit going on.

Yeah, I just learned a few minutes ago about listing my new city and state and my residence for the past 5 years to get a clean record report. Thanks for everybodys help! I'll probably see / meet some of you guys in several months when I get my ass there. And I promise not to come "strapped" or wear a vest of any sort. LOL!

Lochdhu, you are probably unaware, that a month or more back, two mongers got roughed up in a local boliche for not coming across with money to pay a wildly inflated bill. Ripped off and roughed up. So, for a few days after that there was alot of talk on the board about revenge. Have you heard of flushing a shot glass down the toilet and strangling the plumbing?

I brought a bunch of that stuff back from Lebanon in 1983. Plus a Russian frag grenade, an AK-47, and a fully automatic H & K G-3. And yeah, they were just boy toys. In retrospect it was stupid, but in retrospect, I was dumb. Anyway, I had a mild scare with the Russian frag grenade (I thought some idiot had found it and took it) and decided to sell it all off. There have been a few times over the years I wished I still had some of it, but now I'm glad I got rid of it all when I did. I'm sure I would have done something stupid if I had kept any of it.

What's the issue?Well Lucky for me, I didn't lose all my other legal toys, but my probation prohibits me from gun ownership right now, so rather then lose my guns to the cops, I was able to transfer them to my brother, so if the court agrees and makes my case a misdemeaner at the end of my probation next month, I get all my boy toys back. But they will be worthless to me if I move to BA:(

Looking back, yeah, it was stupid of me to even possess that stuff, and a bad error in my judgement, not to be repeated. Here in Idaho gun laws are pretty liberal, here you can own fully automatics, with special tax stamps, which arent to hard to get. Plus you have the right to carry a gun here, unlike other states that must approve you, or you must show justification to carry, here is "Shall Issue" not "May Issue" this guy has a 50 cal mounted on the back of his truck, drives all over town, he lives about 25 mins from me.
